Rather than providing isolated legal advice, our process began with a comprehensive compliance roadmap, mapping every authorisation, permit, and licence that could influence the project’s timeline, cost, and operational readiness.
By identifying key regulatory triggers under the National Environmental Management Act (NEMA), National Water Act (NWA), and National Environmental Management: Waste Act (NEM: WA), our team aligned the client’s strategic and environmental obligations from day one.
Navigating South Africa’s Mining & Environmental Compliance Landscape
With a clear understanding of the client’s operational goals and legislative requirements, we developed an integrated licensing and compliance strategy tailored to their needs. This included:
Environmental Authorisation (EA)
Required under the NEMA EIA Regulations for mining-related infrastructure. Our legal and technical teams worked to ensure that existing approvals were leveraged efficiently, preventing duplication and unnecessary red tape.
Waste Management Licence (WML)
While tailings and processing plants often trigger waste-related activities, our detailed assessment found that the specific project did not require a WML, saving the client significant time and cost.
Water Use Licence (WUL)
Given the project’s water abstraction, storage, and discharge activities, several Section 21 water uses under the NWA were triggered. We assisted with the full Water Use Licence Application (WULA) process, including water-balance studies, stormwater management planning, and public participation with the Department of Water and Sanitation (DWS).
By aligning these three regulatory processes, EA, WML, and WUL, Bishop Fraser Attorneys created an integrated compliance framework that reduced duplication, accelerated approvals, and minimised project risk.
From Consultation to Operation
